Kadazan should get one more minister post

Sabah-based Barisan Nasional component party member, Parti Bersatu Rakyat Sabah (PBRS) is not happy that Chief Minister Datuk Seri Musa Haji Aman did not appoint a leader from the Kadazandusun and Murut community as a minister in the Sabah State Cabinet.

PBRS information chief Rayner Francis Udong said the recent cabinet reshuffle was the best opportunity for Musa, who is Sabah BN chairman, to correct the lopsided Cabinet line-up. He said the party regretted that the Chief Minister did not take the opportunity for that purpose.

Udong said the expected composition of the State Cabinet was 5-3-2, five ministers from the Muslim Bumiputera quote, three from non-Muslim Bumiputera and two for the Chinese community.

The non-Muslim Bumiputera quote is now represented by Deputy Chief Minister Datuk Seri Joseph Pairin Kitingan from Parti Bersatu Sabah and Rural Development Minister Datuk Dr Ewon Ebin from UPKO.

PBRS tells PKR to close shop in Pensiangan

Parti Bersatu Rakyat Sabah (PBRS) president Tan Sri Joseph Kurup is now settled down as Pensiangan member of Parliament after the Friday March 13's Federal Court decision to allow his appeal against a Kota Kinabalu Election Court declaration that his win uncontested in the March 8, 2008 general elections was null and avoid.

Kurup, who is Federal Rural and Regional Development Deputy Minister, had promised that now being cleared of the Election Court's judgement, he is now all focused in bringing more development to his constituents.

A first time MP, Kurup was Sook assemblyman and had served as Sabah Deputy Chief Minister, among other, in the previous Sabah State Cabinet.

Now that Kurup is confirmed as Pensiangan MP, PBRS is calling on opposition Parti Keadilan Rakyat (PKR) Pensiangan headed by Danny Andipai to close shop and bring all his supporters to join Barisan Nasional (BN).

It was Andipai who initiated the election petition against Kurup after his candidacy for the Pensiangan seat was rejected on nomination day of the general elections last year.

In calling PKR Pensiangan to disband, PBRS information Chief Rayner Francis Udong said that only BN, of which PBRS is a component member, could bring about development in the constituency.

"Particiaption of opposition PKR into the BN's fold is most welcomed," he said.

After the Federal Court's ruled in favour of Kurup, Andiapi challenged the PBRS president to vacated his MP seat and contest against him in a by-election. To this Udong said it only showed that Andipai was politically immature.

"We cannot overcome the wisdom of law, justice and what really transpired had been known. So Andipai should respect the decision," Udong said.

Kurup, a first time MP, is Federal Rural and Regional Development Deputy Minister.

Kurup: What's Up Pairin?

Parti Bersatu Rakyat Sabah (PBRS) president Tan Sri Joseph Kurup today said voters in the Pensiangan parliamentary constituency in Sabah are well prepared for a possible by-election, if there is any. He said they already know who they are going to vote.
"As much as I would like not say anything, I am compelled to do so in response to Parti Bersatu Sabah (PBS) president Datuk Seri Joseph Pairin Kitingan's interference over this well prepared PBRS machineries by raising the question of candidature will undoubtedly, to certain extent, weaken this," Kurup said.
Kurup, in a Press statement datelined Putrajaya, Kuala Lumpur, was responding to Pairin's statement which appeared in the local newspapers today.
Speaking to the Press in Kota Kinabalu on Monday (Jan 18), Pairin, who is Sabah Deputy Chief Minister, said there should not be an automatic selection of Barisan Nasional (BN) candidate should a by-election is called for the Pensiangan seat.
Pairin said that although its was normal for BN to give back the seat to component party as was the quota or formula in the March 8, 2008 general elections but that based on the recent Kuala Terengganu by-election result, candidate is an important factor.
In the Kuala Terengganu's by-election BN failed to defend the seat which was won by Opposition PAS.
Asked by the Press if he meant that his PBRS' counterpart, Kurup, should not re-contest in the by-election, Pairin said," No, I am not saying that but candidate is a very important factor."
Pairin said the BN leadership should have to look at the causes of the Kuala Terengganu by-election, which BN lost so as to avoid it from happening in Pensiangan.
Kurup won Pensiangan uncontested in the general election and was appointed Federal Rural and Regional Development Deputy Minister. His victory was declared null and void by a Kota Kinabalu Election Court.
The election petition against Kurup was brought by Parti Keadilan Rakyat's Danny Andipai, whose candidacy was rejected on nomination day, paving the way for Kurup to win the seat without a contest.
Kurup appealed and the Federal Court will sit in Kota Kinabalu on Feb 12 and 13, 2009 to decide on the case.
Kurup further stated that Pairin seemed not to have understood the BN's concept of `sharing' `But here, perhaps he could be excused in view of his colourful and well documented history with the BN.
PBRS and PBS are component members of BN.
"Certainly he does not possess the credibility to assess the suitability of a candidate for Pairin has been the MP for Pensiangan for two terms and his performance record in bringing developments to the people speaks for itself," Kurup said.
He said whenever he go to Sook and Nabawan (two state seats within Pensiangan) people there were saying in no uncertain terms that they had not seen any development in their areas during Pairin's tenure as their MP.

Will there be by-election for Pensiangan?

The Federal Court will sit in Puterajaya tomorrow (Jan 7, 2009) to hear Parti Bersatu Rakyat Sabah (PBRS) president Tan Sri Joseph Kurup's appeal against a Kota Kinabalu Election Court decision on Sept 8, 2008 which declared null and void his election as a Member of Parliament for Pensiangan in the March 8, 2008 general elections.

Judge David Wong Dak Wah ruled that the wrongful rejection of the nomination papers of the petitioner, Parti Keadilan Rakyat’s Danny Anthony Andipai, had breached the petitioner’s constitutional right to take part in the election and the written law relating to the conduct of the election.
Kurup, who was appointed Rural and Regional Development Deputy Minister after the elections, filed the appeal on Sept 11, 2008

Andipai filed the petition on April 9, 2008. His candidacy for the Pensiangan parliamentary seat was rejected by Returning Officer Bubudan OT Majalu on nomination day - Feb 24, 2008.

After rejecting Andipai’s papers, Bubudan declared Kurup of having won Pensiangan uncontested. Andipai sought for a court declaration that Kurup’s win was null and void.

He claimed that Bubudan had planned to make available only on counter for delivery of nomination papers by candidates contesting in Pensiangan and the state seats of Nabawan and Sook.

Andipai claimed that the plan was to prevent the timely delivery of nomination papers of other candidates to enable Kurup to be returned unopposed in the March 8, 2008 general elections.

Andipai was represented by lawyers Datuk Chau Chin Tang and Haji Ansari Abdullah while Kurup’s lawyers were Alex Deccena, Hajah Mariati Robert, Wilson Lai Wai Shing. Senior Federal Counsel Suzana Atan and Chandra Devi had appeared for Bubudan.

By-election in Pensiangan?

Signs of a by-election in the card.

After the Kota Kinabalu Election Court declared Parti Bersatu Rakyat Sabah (PBRS) president Tan Sri Joseph Kurup's win uncontested in the Pensiangan parliamentary constituency during the March 8, 2008 general election null and void on Sept , he had stay put in Keningau, visiting regularly the constituency.

Parti Keadilan Rakyat (PKR) vice-president Datuk Dr Jeffrey Kitingan is also visiting Pensiangan so are other leaders of the opposition party.

Former Pensiangan MP Datuk Bernard Maraat had also offered himself as as a candidate should there be a by-election.

To add `fuel to the fire', Rural and Regional Development Minister Tan Sri Muhammad Muhammad Taib had made official visit, meeting with the Pensiangan constituents. He is now in Sabah and is to tour Pensiangan again tomorrow.

Kurup his Muhammad's deputy being the Rural and Regional Development Deputy Minister.

Information Minister Ahmad Shabery was also in Pensiangan yesterday after he visit the new Radio Station in Keningau. The station will begin operation January 1, 2009 broadcasting in Murut, Dusun and Bahasa Malaysia.

These are all elements preparing for a by-election. Kurup had appealed against the court decision and is yet to be heard. Until the Federal Court hear the appeal and deliver a decision, more Ministers and Opposition leaders are, for sure, be heading to Pensiangan.

Ansari: I am still the boss

Haji Ansari Abdullah (pix) has confirmed tendering his resignation letter as Sabah Parti Keadilan Rakyat (PKR) head but denied having resigned as a member of the opposition party.
He said he had tendered his resignation letter in June, this year but had not received any respond from the PKR headquarters in Kuala Lumpur.

Ansari said until someone is appointed by the party's national leadership to replaced him, he is now still head of Sabah PKR.

Denying reports in the Press of his leaving PKR, he said the reports were damaging and mischievous.

Meanwhile, Danny Anthony Andipai also denied leaving PKR and to join Sabah Progressive Party (SAPP) if not fielded by PKR as candidate for the Pensiangan parliamentary by-election, if any.

"I had workd so hard to get the petition through court to prove my commitment to PKR. Leaving the party never crossed my mind," he said.

Andipai was successful in his election petition when the Kota Kinabalu Election Court had on Sept 8, 2008 declared Parti Bersatu Rakyat Sabah (PKR) president Tan Sri Joseph Kurup's win uncontested in the Pensiangan parliamentery constituency in the March 8, general elections null and void.

The Court of Appeal is yet to hear Kurup's appeal.

Ansari quits PKR?


Sabah senior lawyer Haji Ansari Abdullah (pix left) had tendered his resignation as Parti Keadilan Rakyat's (PKR) Sabah Liaiason Committee head. A source closed to the party revealed to Aki Momogun that Ansari had submitted his resignation letter last week.

He had also told the State Liaison Committee of his intention to quit but no official words was forthcoming from the party's headquarters.

"There is a gag order on it by the party's leadership," the source said.

In another development, PKR Pensiangan division chairman Danny Anthony Andipai (pix right) is said being called by his supporters to quit the party and to join Sabah Progressive Party (SAPP) which had left Barisan Nasional.

Andipai had not denied nor confirmed the matter and when pressed for answer, he said, "Wait and see."

He also said that the matter arises as his supporters were not happy that PKR Vice President Datuk Dr Jeffrey Kitingan was now actively campaigning for candidacy in the event a by-election is held for the Pensiangan parliamentary constituency.

An Election Court had declared the seat vacant, ruling that the election of Parti Bersatu Rakyat Sabah's president Tan Sri Joseph Kurup's win uncontested in the March 8, 2008 general elections.

Kurup, who is Federal Rural and Regional Development Deputy Minister, had appeal against the decision which is yet to be heard by the Court of Appeal. Kurup lost his seat after his victory was being challenged by Andipai.

Andipai was the PKR candidate in the general elections but his nomination papers was rejected by the returning officer resulting in Kurup being declared the winner. One of Andipai's lawyers in the election petition hearing was Ansari.

SAPP opens up new branches in Pensiangan

SAPP still strong despite out from Barisan Nasional

Sabah Progressive Party (SAPP) held its 114th Supreme Council meeting in Sandakan on Oct 28, 2008. One of the decision of the meeting chaired by party's president Datuk Seri Panglima Yong Teck Lee was to open up new branches in Nabawan and to expand its branches in Sook.

Nabawan and Sook are state constituencies that made up the parliamentary constituency of Pensiangan whose MP Tan Sri Joseph Kurup's win in the March 8, 2008 general election was declared null and void by the Kota Kinabalu Election Court on Sept 8, 2008.

Although SAPP did not decide on wheter or not to participate in tbe Pensiangan by-election, if any, the party's decision to open up new branches in Sook and spread its wing in Nabawan are hints that Yong may field a candidate for the MP seat.

A by-election will only be held if Kurup's appeal is dismissed. Hearing of the appeal by the Parti Bersatu Rakyat Sabah (PBRS) president is still pending. Kurup was made the Federal Rural and Regional Development Deputy Minister after he won the Pensiangan's seat unopposed.

PRESS RELEASE

Sandakan, (Oct 28, 2008) Tuesday:

1. SAPP held its 114th Supreme Council meeting at the SAPP office at CLC Elopura Conference Room today. This is the third time that SAPP has held its Supreme Council meeting in Sandakan, the other times being on Jan 19, 1995 at Elopura office, and on June 25, 2006 at Sabah Hotel.

2. For one month, SAPP has been working on the rebuilding and strengthening of the Party in Sandakan due to the departure of leaders in the municipality after SAPP was no longer in BN coalition government. SAPP is greatly encouraged by the people in Sandakan who fervently urged SAPP to strive on and to rebuild SAPP. SAPP promises that the Party shall not let down the people of Sandakan.

3. SAPP is also extremely grateful to local leaders and members who have remained loyal to the Party. In spite of attempts by the departing leaders, especially in Tanjong Papat, to block Sandakan members from meeting SAPP leaders, SAPP is proud that many members have voluntarily contacted the Party HQ, Supreme Councilors and local leaders such as Poon Kee Yang and Tenny Chang Yee Chung to report that they will not leave the Party. Some members even traveled all the way to the Party HQ in Kota Kinabalu to enquire about their membership status after reading news reports of their “mass resignations” from the Party in Sandakan.

4. This proves that the September news rumours of “2000 members resigning from SAPP” and another “15,000 resignations” engineered by the departing leaders is a lie meant to deceive the people and the BN leadership.New Appointments:

5. SAPP hereby announces the appointment of Tuan Hj Kassim Amir Hussein as new supreme councilor. Tuan Hj Kassim has served in various capacity in the Party since its formation in 1994.

6. Datuk Tain Fook En is the new chief for Sungei Sibuga CLC replacing Yap Vui Hun. Datuk Tain was the original chairman of this CLC from 1994 till 2004. He now reverts to this CLC in addition to his current chairmanship of CLC N43 Sekong.

7. The new CLC chairman for N.45 Elopura is Tenny Chang Yee Chiung replacing Au Kam Wah. TennyChang, aged 48, is a founder member of SAPP in 1994. He served as Supreme Councilor from 1994 till 1998 as Assistant Organising Secretary and later as Assistant Secretary General. He was the CLC chairman for Elopura from Jan 19, 1995 till June 29, 1998 before Datuk Tham Nyip Shen took over from there.

8. Chairman for N46 Tanjong Papat is Poon Kee Yang. Poon was first appointed chairman for this Constituency on August 30, 2008 to replace Raymond Tan in order to reactivate this CLC. The appointment today is to establish a team to help Poon build up SAPP in this constituency in order to recapture this seat back to SAPP. Poon was a founder member of SAPP. He has served continuously as Supreme Councilor from 1994 till now.

9. These newly energized CLCs shall now reorganize the branches and reactivate its members and recruit new members. Several gatherings have already been held in the last two weeks and more will be held in the coming month.

10. The Sandakan Zone Committee consisting of the state constituencies of N.41 Gum Gum, N.42 Sungei Sibuga, N.43 Sekong, N.44 Karamunting, N.45 Elopura and N.46 Tanjong Papat is currently headed by the party Secretary General, Datuk Richard Yong We Kong.

11. The meeting have drawn up new line-up for The Sandakan ZoneCommittee, CLC Elopura and CLC Tanjong Papat.Receiving new members.

12. At two gatherings, one held at the party’s Elopura office on October 27 and another held in Sekong on October 28 received 526 new members joining SAPP. This group of new members have applied to join SAPP in Elopura, Tanjong Papat, Karamunting, Sekong and Sungei Sibuga constituencies. The applications forms were received by SAPP president Datuk Seri Yong Teck Lee.SAPP entrenching in 25 districts, 45 constituencies.

13. The Party HQ shall now proceed to other constituencies to form new branches and to strengthen the Party. From November to December, training programmes and new membership induction courses have been arranged in 15 districts consisting of 45 state constituencies. The Party targets to increase the membership from the current 40,000 to 60,000 by year 2010, spread over the 60 State constituencies in Sabah and one parliamentary seat of Labuan FT.P.182 Pensiangan Parliamentrary by-election.

14. The Supreme Council did not make any decision whether to take part in the Pensiangan by-election but decided to form branches in the N.38 Nabawan constituency and to expand the number of branches in the N 37 Sook constituency, which together form the Pensiangan parliamentary constituency.

Najib says Kurup no longer Deputy Minister


Following the Kota Kinabalu Election Court decision to declare the March 8, 2008 general elections result for Pensiangan parliamentary seat null and void, Deputy Prime Minister said Tan Sri Joseph Kurup (Pix) is no longer Federal Rural and Regional Development Deputy Minister.

Speaking to Bernama in Kuala Lumpur, Najib said Kurup is no longer a Deputy Minister as the person holding the post has to be a Member of Parliament.

Najib said kurup can be reappointed to the post if he is re-elected.

"Barisan Nasional will appeal against the decision and at the same time, prepare for a by-election," Najib said.

Appeal will waste Tax payers' money

Former Pensiangan MP Bernard S Maraat said appealing against the court decision would be a waste of public funds.

"Kurup should just accept the court's decision with an open heart and allow due process to take place," he said.

Maraat said if a by-erlection were to be held, he would be returning to win the MP seat following popular demand from the grassroots.

Maraat was Kurup's Parti Bersatu Rakyat Sabah (PBRS) secretary-general until the March 8, 2008 general elections. He quit after Kurup dropped him from defending Pensiangan. Kurup won the seat uncontested. The rest for now is history.

Just last week, Maraat joined Parti Bersatu Sabah (PBS) and was elected the party divisional chairman for Liawan.

Up to PM says Kurup

KOTA KINABALU, Sept 8 (Bernama) -- Parti Bersatu Rakyat Sabah president Tan Sri Joseph Kurup said Monday he would leave it to Prime Minister Datuk Seri Abdullah Ahmad Badawi to decide on his post as a deputy minister.

This follows a Kota Kinabalu High Court decision to declare his victory in the Pensiangan parliamentary seat in the last general election null and void.

Kurup said he did not expect the verdict to favour the petitioner, Danny Anthony Andipai of Parti Keadilan Rakyat, and said that he had instructed his lawyer to apply for a stay of execution of the court's decision and file for an appeal.

The rural and regional development deputy minister said if the appeal still favoured the petitioner, then the Barisan Nasional would make preparation to face a by-election.

"I'm confident that with close cooperation among the BN component parties, we will be able to defend Pensiangan," he told Bernama.

KOTA KINABALU, Mon - The High Court here today declared null and void the election of Parti Bersatu Rakyat Sabah (PBRS) president Tan Sri Joseph Kurup as the unopposed winner of the Pensiangan parliamentary seat in the March 8 general election.

In delivering the landmark judgment, Justice David Wong Dak Wah ruled that the wrongful rejection of the nomination papers of the petitioner, Parti Keadilan Rakyat’s Danny Anthony Andipai, had breached the petitioner’s constitutional right to take part in the election and the written law relating to the conduct of the election.

In his 36-page judgment, Wong said the decision of the deputy director of the Sabah Election Commission to accept Andipai’s nomination papers was final and could not be overruled by the returning officer, Bubudan OT Majalu, under the pretext that there was an objection during the objection period.

The deputy director was exercising a power provided for by law in making the decision, said the judge who also ruled that Bubudan’s decision to uphold the objection was a wrong decision.

“I find certain aspects of the second repondent’s (Bubudan’s) conduct troubling and when taken in its totality, I can only conclude that the decision made was definitely not one which a reasonable tribunal would come to,” he said.

He made the observation when allowing Andipai’s petition to nullify the election result of the Pensiangan seat which Kurup won unopposed on nomination day on Feb 24.
Andipai had named Kurup and Bubudan as respondents. The judgement was to have been delivered on Sept 17 but was brought forward today.

Outlining what happened on nomination day, Wong said Andipai arrived at the nomination centre at the Nabawan District Council Hall at about 9.35am to file his nomination papers for the seat.

After paying the deposit of RM15,000 he waited his turn but when he tried to submit his nomination papers, Bubudan refused to accept them on the ground that he was late in submitting them.

Andipai argued that it was not his fault but that of Bubudan and his staff and having failed to convince Bubudan, he said that he would be lodging a police report.

However, while the discussion was going on, one of the assistant returning officers, Osman Aganduk, sought the advice of the state election commission which gave the directive to accept the nomination papers.

Wong said the directive, which came from the deputy director of the Election Commission of Sabah, was relayed to Bubudan who then accepted Andipai’s nomination papers which were endorsed with the acceptance time of 10.25am.

Objections closed at 11am and at about 1.25pm, Bubudan announced that Kurup was returned unopposed and declared him duly elected on the ground that the nomination papers of Andipai and an independent candidate, Saineh Usau, were delivered after 10am.

Meanwhile
, Kurup can file an appeal against the Election Court's decision in the Federal Court. Election Commission deputy chairman Datuk Wan Ahmad Wan Omar said this was allowed for under the law.

"According to the Election Offences Act 1954, he can file an appeal within 14 days from the day the judgement is passed.

"The Federal Court has six months to dispose the case. Until then, it is too early to say whether there will be a by-election for Pensiangan parliamentary seat," he said when contacted by Bernama.

Pensiangan's Kurup judgement Monday Sept 8

Kota Kinabalu Election Court Judge David Wong Dak Wah, who had earlier fixed Sept 17, this year to deliver judgement on the election petition by Pensiangan Parti Keadilan Rakyat (PKR) division chief Danny Anthony Andipai, will be delivering it tomorrow (Sept 8) at 10am.

Andipai, whose candadicy was rejected on the Feb 24, 2008 nomination day, filed the petition on April 9, 2008 seeking the election of Parti Bersatu Rakyat Sabah (PBRS) president and Federal Rural and Regional Deputy Minister Tan Sri Joseph Kurup in Pensiangan be declared null an void.

Kurup, a former Sabah Deputy Chief Minister, won the seat uncontested.

Pensiangan, Api Api next month

Kota Kinabalu Election Court Judge David Wong Dak Wah will deliver on Sept 17, this year its judgement on the election petition by Pensiangan Parti Keadilan Rakyat (PKR) division chief Danny Anthony Andipai.

Andipai, whose candadicy was rejected on the Feb 24, 2008 nomination day, filed the petition on April9, 2008 seeking the election of Parti Bersatu Rakyat Sabah (PBRS) president and Federal Rural and Regional Deputy Minister Tan Sri Joseph Kurup in Pensiangan be declared null an void.

Meanwhile, Judge Datuk Abdul Aziz Abdul Rahim will deliver judgement for the Api Api election petition on Sept 15, 2008.

The petition was filed on April 9, 2008 by Sabah PKR deputy head Christina Liew's agent Audrey Karen Barry, seeking to nullify Parti Bersatu Sabah (PBS) deputy president and Sabah Resources Development and Information Technology Minister Datuk Dr Yee Moh Chai's win in Api Api in the March 8, 2008 general elections.

In both cases, the petitioners sought to declare the elections' results null and void due to various breaches of the Election Offences Act 1954 and the Elections (Conduct of Election) Regulation 1981.

PKR: See You In Court Kurup

Federal Rural and Regional Development Deputy Minister Tan Sri Joseph Kurup will now have to fight in court to confirm his victory, winning the Penisangan parliamentary seat uncontested, in the March 8, 2008 general elections.

KOTA KINABALU, wed: The Election Court here today dismissed the preliminary objection by Pensiangan Member of Parliament Tan Sri Joseph Kurup to strike out the election petition filed by Parti Keadilan Rakyat (PKR) candidate and fixed July 10 for hearing.

Judge David Wong said in his ruling the election petition filed by PKRs Danny Anthony Andipai on April 9 complied with the requirements under the Election Petition Rules 1954, particularly Rule 4(1)(b) as argued by Kurup's lawyer Alex Decena on June 18.

Andipai's counsel, Haji Ansari Abdullah, who is also Sabah PKR chief, told the court the petitioner would call 10 witnesses while Decena said there were nine witnesses who would testify for Kurup.

Kurup, who is also Deputy Rural and Regional Development Minister and Parti Bersatu Rakyat Sabah president, won the seat uncontested in the March 8 general elections.

Andipai, who was disqualified from contesting, is seeking that Kurup's election be declared null and void.

He claimed the election was not conducted in accordance with the principles of the Election Act 1958 and Elections (Conduct of Elections) Regulations 1981.

Petitions against Kurup

Two election petitions were filed in the Kota Kinabalu High Court in Sabah yesterday, both seeking order to declare the election of Tan Sri Joseph Kurup, the Barisan Nasional candidate for the Pensiangan parliamentary seat.

Kurup, who was declared winner of the seat uncontested, had been sworn-in before the King on March 18 as Federal Rural and Regional Development Deputy Minister, is Parti Bersatu Rakyat Sabah (PBRS) president.

The petitioners are opposition Parti Keadilan Rakyat (PKR) candidate Danny Anthony Andipai and Independent Saineh Usau.

Andipai, accompanied by lawyer and Sabah PKR chief Haji Ansari Abdullah, named Returning Officer Bubudan OT Majalu and Kurup as the first and second respondents, respectively.

Usau through his lawyer Arthur Bonnie named the State Election Officer, Bubudan and Kurup as the first, second and third respondents, respectively.

Both the petitioners are contending that Bubudan had not conducted the election in accordance with the principal laid down under the provision under the Election Act, 1958 and the Elections (Conduct of Election) Regulations, 1981.

They claimed that their candidacies were rejected by Bubudan even though they had complied with all the requirement, amongst others, paid the RM10,000 deposit and another RM5,000 deposit for election materials.

Andipai and Usau claimed that initially the Returning Officer had refused to accept their nomination papers saying that they handed their papers minutes after nomination closed at 10am but were accepted after consulting their lawyers.

Their nomination papers and that of Kurup's were displayed on the notice board during the 10am-11am objection period which both petitioners claimed that they did not received any objection to their candidacies.

However, the Returning Officer announced that there was no contest as Andipai and Usau papers were rejected and their were disqualified from contesting. Kurup was declared the winner - uncontested.

On record, after Kurup was declared winner, he was punched by a member of the public and had to be escorted by police to his car. He had made a police report and that the country's top police officer had said that the `punching of Kurup' was one of the serious incident during the Feb 24, 2008 Nomination Day for the March 8, 2008 general elections

YB Bell Bottom Unopposed

Known for his bell bottom trousers, Parti Bersatu Rakyat Sabah (PBRS) president Tan Sri Joseph Kurup won the Pensiangan parliamentary seat without a contest.

Two other two candidates came to the nomination centre in Nabawan (in the interior of Sabah) but their papers were rejected as they arrived after 10am, the closing time for submitting nomination papers.

First time lucky for Kurup as this is his first attempt for an MP seat as all this while he had been contesting State seats and before the election was called, he was the assemblyman for Sook. The Sook seat is now contested by PBRS deputy President Datuk Elliron Angin.

Kurup's victory angered supporters of the disqualified candidates Saineh Usau of Parti Keadilan Rakyat (PKR) and indedendent Danney Anthony Andipai. They went for Kurup as he emerged from the nomination centre, a man tried to punch him but missed.

Kurup was being led away, escorted by police, to his car.

My congratulations to Kurup. Now we will have YB Bell bottom in parliament. Bell Bottom is his trademark.
